About DABS:

Breshna Sherkat (DABS) is an independent and autonomous company established under The Corporations and Limited Liabilities Law of the Islamic Republic of Afghanistan (IROA). DABS is a limited liability company with all its equity shares owned by the Government of Afghanistan (GoA). The company was incorporated on 4th May 2008 (15 Saur 1387) and replaced Da Afghanistan Breshna Moassassa (DABM) as the national power utility. DABS will operate and manage electric power generation, import, transmission, and distribution throughout Afghanistan on a commercial basis.

Job Descriptions:

To provide contractual and legal support and leadership in the planning, execution, monitoring, and administration of all arrangements/contracts implemented under the PMO

Duties & Responsibilities

  • Oversee and manage all aspects of contract execution and administration of the projects
  • Review and analyze contract documents, including terms and conditions, risk allocation, and implementation schedules
  • Coordinate with the procurement department to ensure a seamless transition from procurement process to contract award
  • Monitor commercial issues and draft contractual correspondence, notices, amendments, and responses to contractual claims
  • Pursue contract amendment with Procurement Department and make sure its processing
  • Acting as an information source on organization policies and procedures pertaining to legal/contract requirements
  • Fill in questionnaire, received for NPA via Procurement Department, with the support of Project Manager
  • Submit regular reports on contract breaches, if any, , identifying risks and recommending performance improvement measures
  • Maintain and update a contract amendment tracking and monitoring system for all project contracts
  • Assist project managers in preparation of narrative report of contract amendment on the bases of change order/contract modification and pursuing it within procurement department
  • Provide legal and contractual input in resolving disputes, handling variations, and managing claims with reference to the relevant clause(s) awarded contract/amendment
  • Guide the Project Manager in systematic documentation and archiving of all contractual communications and records
  • Liaise with consultants, Engineering Procurement and Construction (EPC) contractors/other contractors, and relevant stakeholders to ensure alignment with contract terms
  • Review contractual communications/formal letters prepared by the Project Manager to make sure their alignment with the national laws and Conditions of Contract
  • Provide continuous support and advisory services to Project Manager/Program Manager on all aspects of contract administration
  • Participate in audits and donor/investor review missions by providing contract relevant files and documentation
  • Assist Project Manager in issuing contract closeout report.

Job Requirements:

  • Bachelor’s degree in Economics or Engineering
  • Minimum 5 years of professional experience in contract management specifically in infrastructure projects relevant contracts.
  • Familiarity with FIDIC-based contracts, World Bank/ADB procurement frameworks, and PPP/investor project structures
  • Tremendous knowledge of contract management, risk identification and mitigation, dispute resolution, and contract lifecycle management
  • Excellent analytical, negotiation, and drafting skills
  • Good understanding of project business
  • Extensive experience in contract formation and execution
  • Proficiency in MS Office and relevant contract/project management tools
  • Fluency in written and spoken English is required; knowledge of local languages is a plus
